FAQ
What's the difference between a gross and a net lease?
In a gross lease the rent includes property taxes, insurance and common-area costs. In a net lease the tenant pays a share of those costs on top of base rent. The template asks which you're using.
Can I use this for an apartment or house?
No. Residential leases carry tenant protections and required disclosures that this template doesn't cover. Use the Rental Agreement template for homes and apartments.
Does a commercial lease need to be notarized or recorded?
Usually not to be valid between the parties, but long leases may need to be recorded, or a memorandum of lease recorded, to protect the tenant against later buyers or lenders. Check the rules where the property is located.
Is this lease ready to sign as-is?
It's a starting draft. Commercial leases are heavily negotiated and state rules on deposits, default and eviction differ, so have each side review it — ideally with a real estate attorney — before signing.
