FAQ

Is an offer letter the same as an employment contract?

Not usually. An offer letter summarizes the key terms of a job offer. If you need detailed terms such as a fixed term, severance or restrictive covenants, use a full employment agreement as well.

Should I include at-will language?

Most U.S. private employment is at-will, but Montana has different rules and some roles are covered by union or individual contracts. The letter asks you which applies; check with an employment attorney if unsure.

Does this cover exempt vs non-exempt classification?

It records the classification you choose. It does not decide it for you — classification depends on job duties and salary thresholds under federal and state law.

Can I add a non-compete?

This letter does not include one. Restrictive covenants are regulated differently in each state, so use the separate Non-Compete Agreement template and review it for the employee's state.
