Template clauses
1. Acceptance of These Terms
These Terms govern your access to and use of {{service_name}} at {{service_url}} (the "Service"), operated by the Operator. By accessing or using the Service, or by clicking to accept these Terms, you agree to them. If you do not agree, do not use the Service.2. Eligibility and Accounts
You must be at least {{min_age}} years old to use the Service. If you create an account, you must provide accurate information, keep your login credentials confidential and tell us promptly about any unauthorized use. You are responsible for activity under your account.3. Acceptable Use
You agree not to: (a) break any law or infringe anyone's rights; (b) upload malware or interfere with the Service's operation or security; (c) access the Service by automated means except as we permit; (d) attempt to gain unauthorized access to any account or system; or (e) use the Service to harass, defraud or mislead others.
4. Intellectual Property and User Content
The Service and its content, other than content you submit, are owned by the Operator or its licensors. You keep ownership of content you submit ("User Content") and grant the Operator a non-exclusive, worldwide, royalty-free license to host, display and process it solely to operate and improve the Service. You confirm you have the rights needed to submit your User Content.5. Paid Features
{{#when has_paid_features=yes}}Some features require payment. Prices, billing frequency and renewal terms are shown before you buy. {{billing_terms}} You can cancel as described at the point of purchase or in your account settings.{{/when}}{{#when has_paid_features=no}}The Service is currently provided without charge. If paid features are introduced, their terms will be shown before you buy.{{/when}}6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some jurisdictions do not allow these disclaimers, so they may not apply to you.
7. Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, AND ITS TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO {{liability_cap}}. Nothing in these Terms limits liability that cannot be limited by law.8. Suspension and Termination
You may stop using the Service at any time. The Operator may suspend or end your access if you materially breach these Terms or if needed to protect the Service or other users. Sections 4, 6, 7 and 10 survive termination.
9. Changes to These Terms
The Operator may update these Terms. Material changes will be posted with a new effective date and, where required, communicated to you in advance. Continued use after the effective date means you accept the updated Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of {{governing_law}}, without regard to conflict-of-law rules. {{#when dispute_method=court}}Disputes shall be resolved in the state or federal courts located in {{court_location}}, unless the law of your place of residence gives you the right to bring claims elsewhere.{{/when}}{{#when dispute_method=arbitration}}Disputes shall be resolved by binding individual arbitration seated in {{arbitration_location}}, except that either party may bring an individual claim in small-claims court. Consumer arbitration terms may be limited by applicable law.{{/when}}11. Contact

FAQ
Do users need to sign terms of service?
No. Terms of service are adopted by the operator and accepted by users — usually through an unticked checkbox or a clear 'By signing up you agree' statement next to the sign-up button. Keep a record of which version each user accepted.
Do I also need a privacy policy?
If you collect personal information — including emails, analytics or cookies — you will usually need a separate privacy policy. Terms of service do not replace it.
Is an arbitration clause enforceable?
It depends on where your users are and how they accepted the terms. Consumer arbitration rules vary by jurisdiction, so review this section with a lawyer if disputes are a real risk.
Does this make my website compliant?
No template can guarantee that. The wording has not been reviewed by an attorney, and requirements depend on your business, users and location. iContract is document software, not a law firm.
